For the purposes of these Terms and Conditions, “The Company” refers to Steve’s Plumbing & AC Service and Hawai’i Energy. The “Grand Prize” refers to one 4-ton Central System, or 4-tons of MiniSplit cooling capacity (up to 4 heads) and installation (ductwork not included).
2nd Place Prize refers to $1,000 off of an AC and installation. 3rd Place Prize refers to $500 off of an AC and installation. All contestants with an AC that is 8 years or older are eligible for a complimentary, no-cost AC tune-up. “The Party” refers to contestants who enter the contest by submitting this form.
By entering the competition, The Party agrees to be bound by these Terms and Conditions. All entries must be received by 11:59 pm HST on 31 May 2024. One (1) winner for each prize in Hawaii will be selected by The Company on 1 June 2024, based on the verified age of the AC systems. The winner will be notified on or after this date.
The Company’s competitions are open only to residents of Hawaii. One (1) winner for each prize will be chosen from all entrants and across all platforms. Party must be the homeowner of the property in which the AC resides. The promotion applies to residential use only, not commercial. Winners must reside within the Company’s service area.
By entering this competition, The Party grants The Company permission to use their name, city of residence and submitted photographs on the Company’s social media accounts, on the Company website, and on other media outlets without acknowledgment or recognition given to the Party. Winners must agree to have their photo taken for use in announcing the contest winner in media outlets.
The Party grants the Company creative permission to alter the photographs, permitting that the photographs are not altered in an explicit manner or cause malicious representation of the Party and their associates.
The Party consents to any third party (including any agency, client, publication, or other organization or institution) in whole or in part, for distribution (“sharing”) of the photographs on their social media accounts, for the purposes of publicity and promotion of the Company.
In giving this consent, the Party releases the Company from liability for any violation of any personal or proprietary right the Party may have in connection with all third parties’ use of the images on any media.
The Party consents to receive marketing and promotional texts, calls, and emails from or on behalf of Steve’s Plumbing & A/C Service and its affiliates using an automated system or auto dialer for any purpose, including plumbing, AC services and drains/sewer. Consent is not a condition of this competition, and The Party can opt-out at any time.
No purchase is necessary. Winners will not be required to pay to enter the competition.
The Party must be over 18 year of age to enter.
The Party must own the home of which a mini-split or central AC system is installed; AC window units are not eligible.
Employees of The Company are not eligible to enter.
Only one entry per person per competition will be accepted.
The Company will not be held liable if the named prizes become unavailable or cannot be fulfilled. The Company will not be held liable for any failure of receipt of entries. The Company takes no responsibility for any entries which are lost, delayed, illegible, corrupted, damaged, incomplete, or otherwise invalid.
To the extent applicable by law, The Company’s liability under or in connection with the competition or these Terms and Conditions shall be limited to the cost price of the prize in question.
To the extent permitted by applicable law, The Company shall not be liable under or in connection with these terms and conditions, the competition, or any prize for any indirect, special or consequential cost, expense, loss or damage suffered by The Party even if such cost, expense, loss or damage was reasonably foreseeable or might reasonably have been contemplated by The Party and The Company and whether arising from breach of contract, tort, negligence, breach of statutory duty or otherwise.
Prizes are non-negotiable, non-transferable, and non-refundable. No cash alternative is available. Where a Prize becomes unavailable for any reason, The Company reserves the right to substitute that prize for a prize of equal or higher value.
The name, address, email address and phone number of the winner must be provided to The Company if requested and will be shared to enable fulfilment of the prize. Winners may be required to sign a 1099 form including their social security number to report winnings for tax purposes.
In the event of unforeseen circumstances beyond The Company’s reasonable control, the Company reserves the right to cancel, terminate, modify, or suspend the competition or these Terms and Conditions, either in whole or in part, with or without notice. The Company’s decision is final. No correspondence will be entered into.
The Party’s name, likeness and social media username may be posted on the social media profiles of The Company after the winner has been selected.
